**Important Notice:

THIS AGREEMENT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. THIS AGREEMENT AFFECTS YOUR RIGHTS WITH RESPECT TO ANY DISPUTE BETWEEN YOU AND JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES, WHICH MAY REQUIRE YOU TO RESOLVE THE DISPUTES IN INDIVIDUAL ARBITRATION, BINDING AND NOT IN COURT.
PLEASE BE SURE TO READ THE "PAYMENT DISPUTES" SECTION, ALONG WITH THIS ENTIRE AGREEMENT CAREFULLY, BEFORE INSTALLING ANY PRODUCTS, GAMES, SERVICES OR OTHER THAT ARE PROVIDED BY JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES.

You are required to be an adult (over the age of 18 years in your country or state of residence), and by installing or continuing, you agree this statement is true and accurate. If you are under 18 years in your country or state of residence, you solely represent that your immediate guardian or parent consents to this Agreement. By installing or continuing, you additionally agree one of these statements are true and accurate.
Thank you for inquiring about JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES' products, services, software and games. The following products are listed but not limited to; "Shadow Redemption", "Shadow Redemption Franchise" and "Blessing Quest". You agree this list can be changed by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES at any time for any reason, and you fully consent to this Agreement.
IF YOU DO NOT AGREE TO THESE TERMS OF AGREEMENT, YOU ARE NOT ALLOWED TO INSTALL, COPY OR USE JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES' PRODUCTS, SERVICES, SOFTWARE AND GAMES. IF YOU REJECT THIS AGREEMENT WITHIN FOURTEEN (14) DAYS AFTER YOUR PURCHASE OF ONE OR MORE OF  JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES' PRODUCTS, SERVICES, SOFTWARE AND/OR GAMES, YOU ARE ELIGIBLE FOR ONE (1) REFUND IN THE EXACT AMOUNT YOU WERE CHARGED. YOU AGREE THAT IF YOU PURCHASED ANY GAMES DEVELOPED OR PUBLISHED BY JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES ON STEAM (PC), THE APP STORE (APPLE) OR THE PLAY STORE (GOOGLE) THAT JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES IS NOT HELD LIABLE TO REIMBURSE YOU AND INSTEAD, YOU AGREE THAT YOU WILL CONTACT THE DESIGNATED RETAILER YOU ORIGINALLY PURCHASED THE SOFTWARE, PRODUCT, SERVICE OR GAME THROUGH. YOU AGREE THAT IT IS EACH INDIVIDUAL RETAILER'S OR PLATFORM'S RIGHT TO REFUSE REFUNDS AND/OR UPHOLD THEIR OWN ADDITIONAL POLICIES AND PROCEDURES THAT ARE NOT CONTROLLED OR DOCUMENTED BY JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES.
You Agree that your use of software, services, products and games developed or published by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES is your responsibility to uphold and follow through with this Agreement. If you Fail to uphold and follow this or any other Agreement distributed by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES, you Agree that JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES is not liable for any damages, privacy loss, physical loss, digital loss, financial loss or any other situation. You additionally Agree that you are held liable for your own actions, decisions and/or motives. You additionally Agree you will solely be responsible for punishments or charges granted to you by your country of residence, and/or JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. You Agree that you will not attempt to charge and/or convict JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES of any wrong-doing, as you have read this Agreement carefully and completely.
You Agree that JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES has the right to monitor and/or record your communications while using any of JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES' products, services, software or games. JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES has the right to disclose your communications or data at any time for any reason, Including but not limited to; (1) To satisfy any applicable regulation, law, government request or legal process. (2) to uphold, protect and or discuss the terms of this Agreement or any other JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES policies or Agreements. (3) To protect JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES' legal rights and resolutions; (4) To protect the well-being, safety or health of anyone that JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES believes may be threatened; or (5) to report offensive behavior or a crime.

GRANT LICENSE

If you Accept and uphold this Agreement, JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES grants you a revocable, limited, non-sub licensable, non-exclusive license to use JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES' products, services, software and/or games. You Agree that a Grant License is not a physical or digital asset you own or can acquire without JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. You Agree that JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES can change, alter, or edit any or all sections of this Agreement, including each section, such as the Grant License section and the License Limitations section. As well, you Agree that you will follow and uphold all terms in this Agreement.

LEGAL LIMITATIONS AND NOTICES

If you have had your Grant License revoked, suspended or banned, you Agree you will not use the software, services, products or games developed or published by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. If you continue to use products without permission or against this, and/or any other policy or procedure distributed, updated, edited and/or posted by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES,  you Agree you are in violation of this Agreement and you will be liable for court costs, lawyer fees and reimbursement allocation directly to JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. You Agree the minimum amount you are held liable to pay to JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES is ONE THOUSAND, TWO-HUNDRED AND SIXTY-SEVEN DOLLARS, ($1,267.00) EQUIVALENT TO USD (U.S. DOLLARS). You Agree the maximum amount you are held liable to pay to JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES is SEVEN MILLION, SEVEN-HUNDRED AND SEVENTY-SEVEN THOUSAND, SEVEN-HUNDRED AND SEVENTY-SEVEN DOLLARS, ($7,777,777.00) EQUIVALENT TO USD (U.S. DOLLARS). You Agree you will automatically be presumed as the guilty party and waive your right to prosecute or charge JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. Additionally, you agree that JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES is automatically granted full legal rights to take ownership of any properties, physical assets, digital assets and/or financial assets in the event that you are found responsible to pay JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES, but the monetary value exceeds the total funds you can acquire. Additionally, you Agree that in this circumstance, you will voluntarily give up all your properties, physical assets, digital assets and/or financial assets to JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. You Agree that if you still owe an amount in this circumstance, the total sum of all properties, physical assets, digital assets and/or financial assets will not count as complete payment, and you will be responsible for paying the remainder of the total funds owed to JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES.

By accessing, installing, using or operating any software, products, programs, services or games developed or published by  JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES, you Agree you have read this entire Agreement and it is accurate and true to your fullest understanding. You Agree you take on the responsibility of this and/or any other policies, clauses, terms, posts or Agreements that are designed, distributed, updated, edited and/or posted by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. You additionally Agree that this and/or any other policies, clauses, terms, posts or Agreements  can change or be altered at any time, at any point, for any reason only by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES. You Agree that if any of these policies, clauses, terms, posts or Agreements change, you Agree to the latest version of any documents, terms, clauses, policies, posts and Agreements that are designed, distributed, updated, edited and/or posted by JEFFREY SCOTT MCBRIDE II / TGOTHIC GAMES and you Agree it is your responsibility to research the newest version of any terms, clauses, policies, posts and Agreements, and you automatically Agree to these terms, clauses, policies, posts and Agreements.
